State Supreme Court To Hear Case Over Recess Assault

WATERBURY, Conn. (AP) — The Connecticut Supreme Court is scheduled to hear the appeal of a mother whose daughter was assaulted by another student during an elementary school recess.

The Republican-American reports that the case centers on whether a lower court should have required an expert to testify on how many adults were needed to supervise the recess.

Tacarra Smith had sued the Waterbury Board of Education after her daughter was pushed into a brick wall during recess in 2012.

She alleged in her lawsuit too few adults were supervising the nearly 400 students.

A Superior Court judge ruled in her favor in 2016, saying the city was liable for more than $7,000 in medical expenses and $60,000 for future treatment.

The state Appellate Court reversed the decision last year.
